1. Acceptance of Terms

By accessing or using Vidou's AI image to video generator service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately stop using the Service. These Terms constitute a legally binding agreement between you and Vidou.

2. Description of Service

Vidou provides a browser-based AI image to video generator that transforms static images into short videos using artificial intelligence. The Service is intended solely for lawful, ethical, and non-harmful content creation.

3. Strict Content Policy

3.1 Vidou enforces a zero-tolerance policy on prohibited content. You are strictly forbidden from using the Service to create, upload, process, or distribute any of the following:

3.1.1 NSFW & Sexually Explicit Content

• Nudity, pornography, or sexually explicit material of any kind
• Sexually suggestive or provocative content, including partial nudity
• Content depicting or simulating sexual acts, arousal, or fetish material
• Non-consensual intimate imagery (real or AI-generated)
• Any sexual content involving minors — this is an absolute prohibition with zero exceptions

3.1.2 Violence & Harmful Content

• Graphic violence, gore, mutilation, or torture
• Content promoting self-harm, suicide, or eating disorders
• Content glorifying or inciting violence, terrorism, or extremism
• Animal cruelty or abuse
• Content depicting or promoting illegal drug use or substance abuse

3.1.3 Deception & Misinformation

• Deepfakes or synthetic media intended to deceive, defraud, or manipulate
• Impersonation of real individuals without their explicit consent
• Fake news, disinformation, or propaganda designed to mislead
• Fraudulent or scam-related content
• Content that misrepresents AI-generated media as authentic recordings of real events

3.1.4 Hate & Discrimination

• Content promoting hatred, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Slurs, dehumanizing language, or symbols of hate
• Content that bullies, intimidates, or targets individuals or groups

3.1.5 Illegal & Restricted Activities

• Content that violates any applicable local, national, or international law
• Content infringing on copyrights, trademarks, or other intellectual property rights
• Content promoting illegal activities, including but not limited to hacking, fraud, and trafficking
• Unauthorized use of another person's likeness, identity, or personal data

3.2 Enforcement: Vidou reserves the right to use automated systems and manual review to detect and block prohibited content. Any content found in violation will be immediately removed, and the offending user may be permanently banned from the Service without notice.

3.3 Reporting: Vidou may report illegal content and associated user information to law enforcement authorities as required by law, particularly in cases involving child sexual abuse material (CSAM), terrorism, or other serious criminal offenses.

3.4 User Responsibility: You are solely and fully responsible for all content you create, upload, or generate using the Service. Violation of this content policy may result in immediate termination of access, legal action, and reporting to relevant authorities.

4. Acceptable Use

4.1 You agree to use the Service only for lawful purposes. In addition to the content prohibitions above, you agree NOT to:

• Use automated bots, scrapers, or scripts to access or overload the Service
• Attempt to reverse engineer, decompile, or extract the underlying AI models or source code
• Circumvent or attempt to bypass any content moderation, rate limiting, or security measures
• Resell, sublicense, or redistribute the Service or access to it
• Use the Service to generate spam, unsolicited advertisements, or phishing content
• Interfere with or disrupt the integrity or performance of the Service

5. Intellectual Property Rights

5.1 Your Content: You retain ownership of the original images you upload, provided you have the legal right to use them. You are solely responsible for ensuring your uploads do not infringe any third-party rights.

5.2 Generated Content: You may use videos generated through the Service for personal or commercial purposes, subject to full compliance with these Terms, including the content policy. Vidou makes no representations regarding the copyright status of AI-generated content under applicable law.

5.3 Our Service: The Vidou platform, brand, technology, design, and AI models are the exclusive property of Vidou and are protected by intellectual property laws. No license or right is granted to you beyond the limited right to use the Service as intended.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. VIDOU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIDOU AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

8. Indemnification

You agree to indemnify, defend, and hold harmless Vidou and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) any content you create, upload, or generate; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we handle your information.

10. Termination

Vidou reserves the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to violation of these Terms or the content policy. Upon termination, all rights granted to you under these Terms will immediately cease. Vidou may also take any additional action it deems appropriate, including legal action and referral to law enforcement.

11. Modifications

11.1 Service: We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

11.2 Terms: We may update these Terms at any time. Material changes will be reflected in the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in courts of competent jurisdiction, as determined by applicable law. You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
